Current Funding Information for 2008-2009
Due to the passage of Proposition 1C (The Housing and Emergency Shelter Trust Fund Act of 2006) approximately $31 million in EHAP Capital Development funds will be available for the fiscal year 2008-2009. These funds will be a combination of the remainder of Proposition 46 funds and a portion of the funds available through Proposition 1C. These funds are available as forgivable deferred loans for capital development to acquire, construct or rehabilitate sites for emergency shelters, transitional housing, and safe haven facilities for homeless persons.

Contract Provisions
Since the EHAP Capital Development funds are released per EHAP Regulations in the form of a deferred loan, the program’s statutes require security in the project site. Please refer to the bullets below: Standard Agreement template, sample escrow instructions, security documents, leasehold interest requirements, report forms, and the Request for Disbursement form.

A sample of the development contract that existing EHAPCD awardees have executed with the State is provided for your review. - Model Bid Package (Currently Being Revised)
Construction and rehabilitation projects in excess of $25,000 that are to be funded with EHAPCD financing should follow the written bidding procedures contained in this package and must be accepted by the Department prior to their release by you. This package also contains the details about the prevailing wage requirements that were effective January 1, 2002, that also must be adhered to. - Subordination Agreement

Note that projects under major construction will require evidence of Builders Risk and General Liability Insurance prior to escrow closure. For all other project types, evidence of Hazard Insurance is required for replacement cost as a minimum or to cover the total borrowed on the project. Note that a recorded Ground Lease or Lease Memorandum is required either prior to or through the EHAPCD escrow process. - Reporting Forms (Microsoft Word)

Requests for Disbursements should be submitted with invoices or other detailed supporting documentation specified by the Department for each warrant requested by an organization. Warrants generally take approximately 4 to 6 weeks for release by the State Controller’s Office. Faxed copies of Request for Disbursement are acceptable, when followed-up with the original executed document. When your organization is requesting funding for construction and/or rehabilitation activities, remember to deduct the 10% retention from each progress payment, if your contractor has not already done so in the project invoice.
